Correct answer: D. No — a licensed amateur radio operator is specifically and permanently exempt for two-way radio use

Section 13 of O. Reg. 366/09 exempts a driver who holds a valid radio operator certificate under the Radiocommunication Act (Canada) from the hand-held device ban specifically for a two-way radio. This exemption, along with a similar one for commercial drivers, was originally time-limited but the Ministry of Transportation made it permanent effective February 14, 2020, removing the sunset clause that used to apply.
